====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 13-12-2021 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

Learned counsel for the petitioners are expected to honour their undertaking to remove the defects, as pointed out by the office, when called upon to do so by the office.

The petitioner is/are apprehending his/their arrest in connection with Ghanshyampur P.S. Case No. 33 of 2020 for the offence registered under Sections 341, 323, 324, 447, 307, 354, 379 and 504/34 of the Indian Penal Code.

Allegation as alleged against the petitioner is that the petitioner, Ranjit Chaupal has wrong intention against her and he has been teasing. It is further alleged that petitioner Bhikhari Choupal

Patna High Court CR. MISC. No.16990 of 2021(2) dt.13-12-2021 2/2 reached her and asked for sexual pleasure. It is further alleged that the petitioners assaulted with Bhala and farsa upon her. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in the present case due to personal grudge and previous enmity. It is further submitted that there is case and counter case between the parties. It is further submitted that vide annexure -3 & 4 series, two persons namely, Devan Chaupal and Chandra Rekha Devi are injured but the injuries sustained by them are simple in nature.

Considering the facts and circumstances of the case, let the petitioners, above named, in the event of his/their arrest/surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Biraul, Darbhanga in connection with Ghanshyampur P.S. Case No. 33 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
