Petitioner, who is in custody, seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 302 of the Indian Penal Code and Section 27 of Arms Act. Informant has alleged in her fardbeyan that on 29.05.2019 in the night, the marriage of daughter of Kaleshwar Mathto was being solemnized and barati had arrived, in the midnight, petitioner along with other co-accused persons armed with pistols were making indiscriminate firing and there is allegation against Bablu Singh (petitioner) of firing upon her daughter as a result she died on spot.
It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case
Patna High Court CR. MISC. No.4629 of 2020(2) dt.23-01-2020 2/2 only on the basis of suspicion. Informant has been examined as P.W. 1, in which although she has admitted that her daughter Baby Kumari sustained bullet injury but she is not aware who had fired. She has been declared hostile. Petitioner is in custody since 01.08.2019.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Sessions Trial No. 243 of 2019 arising out of Dharhara P.S. Case No. 122 of 2019, subject to conditions:
(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court.
(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
