JUSTICE ASHUTOSH KUMAR ORAL ORDER 07-03-2022 Heard Mr. Raj Kishor Prasad, learned Advocate for the petitioners and Mr. Anant Kumar-1 for the State. This petition has been moved only with respect to petitioner no.3 as the case of petitioner nos. 1 & 2 has already been dismissed as withdrawn.
The petitioner no.3 seeks bail in anticipation of his arrest in connection with Rajgir P.S. Case No. 146 of 2020 dated 03.05.2020 (G.R. No. 2247 of 2020) instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 379, 506, 504/34 of the Indian Penal Code and Section 27 of the Arms Act. Though the accusation in the F.I.R. against him and
Patna High Court CR. MISC. No.17142 of 2021(3) dt.07-03-2022 2/2 another is of firing from his fire-arm weapon but, no body has received any gun-shot injury in the occurrence. On the contrary, the Informant has received simple injuries which are said to have been caused by hard and blunt substance. The petitioner was earlier made an accused in another case but, he is on bail in the aforesaid case. Regard being had to the aforesaid stated fact, the petitioner no.3 is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Rajgir P.S. Case No. 146 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
