JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. According to the prosecution case, it was co-accused Dhananjay Mallah, who gave tangi blow on the head of the deceased. So far as petitioner is concerned, no specific overt act has been attributed against him and it is only stated that he along with others assaulted the deceased.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Bhabhua P.S.Case No. 152 of 2015.
