2. The petitioner is in custody since 16.12.2015 in connection with Hilsa P.S. Case No. 276 of 2015 for the offences alleged under Section 384 of the Indian Penal Code and Sections 13, 16 and 18 of Unlawful Activities (Prevention) Act, 1967.
3. It is submitted that the petitioner has been falsely implicated as he is not concerned with the Mobile No. 9102039902 from which ransom call is said to have been made. It is further submitted that criminal antecedents of the petitioner are all related to offences under Section 307 of the Indian Penal Code relating to family disputes. A statement has been made at the Bar that recovery of country
Patna High Court Cr.Misc. No.24924 of 2016 (3) dt.26-07-2016 2/2 made pistol has been made in connection with Hilsa P.S. Case No. 550 of 2015 in which the petitioner has been granted bail.
4. Having regard to the entirety of the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IInd Hilsa, Nalanda in connection with Hilsa P.S. Case No. 276 of 2015 with additional conditions that one of the bailors will be a close relative of the petitioner; and the petitioner shall remain physically present on each and every date during trial and in the event of failure to do so on three consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the Court concerned.
