2. The present application has been filed:

for setting aside the notice contained in letter no. 378 dt. 25.07.17 issued under the signature of the Circle Officer, Dulhin Bazar, Patna addressed to the petitioner and others, so far as the petitioner is concerned whereby the petitioner was asked to appear in Case No.

13/2016-17; for holding the said notice/proceeding to be illegal in view of the pendency of the Title Suit No. 3/2005 in the Court of learned Sub Judge-1, Danapur with respect to the same land in question and for grant of all other reliefs to which the petitioner is found entitled in course of hearing of this application.

3. Learned State Counsel submits that a perusal of the

Patna High Court CWJC No.12872 of 2017(2) dt.28-04-2025 2/2 plaint would show that simple notice was issued by the Circle Officer, Dulhin Bazar, Patna which has been challenged in the present petition.

4. Be that as it may, since there is no appearance, the same is dismissed for non-prosecution.
