The petitioner seeks bail in connection with Marhowrah Goura O.P. P.S. Case No. 663 of 2021 instituted for the offences under Sections 30 and 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 25.11.2021, charge-sheet has been submitted in the case and has antecedent of three cases. Learned counsel for the petitioner submits that the allegation is of recovery of 350 litres of liquor from an open space.

Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and name of the

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 4,000/- (Rupees Four Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise, Saran at Chhapra in connection with Marhowrah Goura O.P. P.S. Case No. 663 of 2021.
