The petitioner is in custody since 04.04.2016 in connection with Sursand P.S. Case No. 274 of 2015 registered for the offence punishable under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner was not named in the F.I.R. but his name has surfaced on the basis of the confessional statement made before the police by co-accused namely, Idrish Nut who has since been extended the privilege of regular bail in Criminal Miscellaneous No. 17950 of 2016 vide order dated 29.04.2016. Considering the aforementioned facts and

No.24511 of 2016 (2) dt.02-06-2016 2/2 circumstances and that the statement made before the police by co-accused Idrish Nut has no evidentiary value in the eye of law, let the petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned S.D.J.M. Pupari at Sitamarhi in connection with Sursand P.S. Case No. 274 of 2015.
