Petitioner is not named in the first information report and it appears that name of this petitioner surfaced in course of investigation in the confessional statement of co-accused.

Moreover, petitioner is in jail custody since 5.1.2015 without having allegation of any specific overt-act against him. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Adhoc. Addl. Sessions Judge II, Sitamarhi in Sessions trial no. 189/2015 arising out of Belsand P.S. Case no. 31/2010.
