JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-06-2020 Heard Mr. Pramod Mishra, learned counsel for the petitioner and Mr. Madan Kumar, learned APP for the State. The petitioner, who is in custody since 16.10.2019, seeks bail in connection with Saharsa Sadar P.S. Case No. 926 of 2019, dated 16.10.2019, instituted for the offence under Section 395 of the Indian Penal Code.

A dacoity was committed in the shop of the informant when some of the accused persons were arrested. Those persons named their other associates also. The petitioner has not been named in the F.I.R.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.4486 of 2020(3) dt.05-06-2020 2/2 that he was arrested on suspicion and was made to give a statement under duress which has been converted into his so-called confessional statement. There has not been recovery of any incriminating article/material from the possession of the petitioner and he has also not been put on Test Identification Parade.

The three other cases in which the petitioner has been made accused in the past about which reference has been made in paragraph 3 of the bail petition, he is on bail. Considering the facts aforestated, the petitioner above-named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 926 of 2019.

The application stands allowed.
