The petitioner seeks bail in a case registered for the offences punishable under sections 364/34 of the Indian Penal Code. Later on section 302 of the Indian Penal Code was added. The informant, son of the deceased, alleges that his father was missing for the last four days. On enquiry it transpired that his father was a watchman in Agwanpur Agriculture Farm and in the night of 27.12.2012 his father had gone on duty but did not return in the morning. The informant alleges that his father had dispute with the petitioner and other accused persons with regard to payment of wages amounting to Rs.2,50,000/-.
Patna High Court Cr.Misc. No.35824 of 2015 (2) dt.21-08-2015 It is submitted that except suspicion there is no material on record. Even the petitioner is not the person last seen with the deceased. Similarly situated co-accused, namely, Bachanu Jha @ Amarnath Jha and Raushan Jha have already been enlarged on bail. The case of the petitioner stands on the same footing.
Considering the facts aforesaid, the petitioner above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Saharsa P.S. Case No. 701 of 2013.
