JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-08-2021 The petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 1197 of 2014 in which cognizance has been taken against him under Section 420 of the Indian Penal Code and Section 138 of the Negotiable Instruments Act.
Mr. Dharmendra Kumar Paswan, the learned Advocate for the petitioner, after some arguments, seeks
Patna High Court CR. MISC. No.14330 of 2020(2) dt.16-08-2021 2/2 permission to withdraw this application in order to enable him to surrender before the Court below and seek bail on the condition that he shall return the dues amount after a soft installment is fixed.
In case such an application is filed, the Court below shall look into the entire set of facts and the submission advanced on behalf of the petitioner and shall pass orders in accordance with law without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
