JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-02-2020 Heard learned counsel for the petitioner, counsel appearing on behalf of the State and counsel for the informant. The petitioner is apprehending arrest in connection with Dariyapur P.S. Case No. 337 of 2019 for the offences under Sections 341, 323, 498(A), 504, 34 of the Indian Penal Code read with 3/4 of Dowry Prohibition Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case marriage took place on 10.03.2018. As per the statement of the petitioner in para 8 of the application, the petitioner is ready to keep his wife with full dignity.

Patna High Court CR. MISC. No.7246 of 2020(2) dt.29-02-2020 2/2 Considering the aforesaid, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bonds of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran, Chhapra in connection with Dariyapur P.S. Case No. 337 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

On release the petitioner shall be under obligation to keep his wife with full honour and dignity. In the event, it is reported that petitioner has neglected in keeping his wife with full honour and dignity or misbehaving his wife or committing any torture, the bail bond of the petitioner shall be cancelled.
