JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-08-2015 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the complainant is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 323, 504, 379 and 498A of the Indian Penal Code.
The basic accusation is of torture.
On instruction, learned counsel for the petitioner submits that the petitioner admits his marriage with the complainant but the complainant has filed altogether 3 cases with similar accusation being Laheriasarai P.S. Case No. 594 of 2014, Dalsingsarai P.S. Case No.442 of 2014 and the present one Complaint Case No.345 of 2014. The petitioner has been granted bail by the learned court below in Dalsingsarai P.S. Case No.442
Patna High Court Cr.Misc. No.34959 of 2015 (2) dt.24-08-2015 2/2 of 2014 after remaining in custody for substantial period whereas in Laheriasarai P.S. Case No. 594 of 2014 notices have been issued for appearance of the complainant Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Dalsingsarai, Samastipur in connection with Complaint Case No.345 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
