.... .... Opposite Party/s ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 08-08-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Section 379 of the Indian Penal Code.

According to informant, he along with other persons went to attend a marriage ceremony in Windsor Hotel at Exhibition Road, Patna after parking his Tavera Car by the side of the road and on returning from there he found his car missing. Petitioners have been made accused in this case on the basis of confessional statement of the co-accused.

It has been submitted on behalf of the petitioners that they are in custody since 24.2.2016. Chargesheet has been submitted against the petitioners. No allegation of tampering of witnesses is alleged against the petitioners. Petitioners are not named in the F.I.R. The name of the petitioners has come on the basis of confessional statement of co-accused, namely, Jay Prakash @ Baba. Petitioners have not been put on T.I.P. Other co-accused, namely, Jay Prakash @ Baba has been granted bail vide Cr. Misc. no. 23695 of 2016.

Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna, in connection with Gandhi Maidan P.S. Case no. 50 of 2016.
