Heard Mr. Vikas Ratan Bharti, learned counsel appearing for the petitioner, Mr. Saurabh Suman, learned counsel for the Religious Trust Board and learned counsel for the State.

2. The present writ application has been filed by the petitioner for quashing the notification bearing no. 1869 dated 30.01.2012 passed by the Bihar State Religious Trust Board, Patna which contains the scheme.

3. After making some argument, learned counsel for the petitioner submits that he wants to withdraw the present writ application for pursuing alternative remedy available to the petitioner under Section 32(3) of the Bihar Hindu Religious Trust Act, 1950, which requires an application to be filed before the District Judge.

4. The respondents counsel appearing for Bihar State Religious Trust Board and the State do not have any objection to

3/4 this prayer being made by the petitioner.

5. As prayed for, the present writ application is dismissed as withdrawn with liberty to the petitioner to pursue his remedy under Section 32(3) of the Bihar Hindu Religious Trust Act, 1950.
