JUSTICE SHIVAJI PANDEY ORAL ORDER 04-01-2021 Heard learned counsel for the petitioner and Mr. Shailendra Kumar, learned counsel for the State. In this case, the petitioner is seeking regular bail in connection with Special Case No. 168 of 2019 arising out of Bakhtiyarpur P.S. Case No. 284 of 2019 registered for offence punishable under sections 457, 376, 511 of the Indian Penal Code and S. 7/11 of the POCSO Act.
Allegation has been made that the petitioner has entered into the house and tried to outrage modesty of the daughter of the informant. He was nabbed at the spot and handed over to the police. The petitioner has criminal history of same nature that too against a minor.
In such view of the matter, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail
Patna High Court CR. MISC. No.5871 of 2020(6) dt.04-01-2021 2/2 is rejected. However, the court below is directed to expedite the trial and conclude the same within nine months from the date of production/receipt of a copy of this order. If the trial is not concluded by the aforesaid period, the petitioner will have liberty to renew his prayer for bail.
