The petitioner seeks bail in a case registered for the offences punishable under sections 302, 120-B/34 of the Indian Penal Code and section 27 of the Arms Act. The informant alleged that he along with his cousin had gone to participate in an inaugural function of grocery shop near Ram Bandh Bus Stand. Govind Singh, Bisheshwar Singh, Yogesh Pandey and Janeshwar Chandrabanshi along with two other unknown persons came there on three motor cycles. One of the unknown persons made firing on temporal region of deceased Navin Singh, who died on the spot. The occurrence took place due to land dispute between the deceased and Govind Singh.
Patna High Court Cr.Misc. No.34071 of 2015 (2) dt.20-08-2015 It is submitted that except the so called confession of Rahul Sharma, the police did not collect any tangible material against the petitioner. Co-accused Vijay Kumar Singh has already been enlarged on bail by this Court vide Criminal Misc. No. 26033 of 2015, Considering the facts aforesaid, let the petitioner above named be directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Town) P.S. Case No. 95 of 2015.
