JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-04-2019 The petitioner apprehends his arrest in connection with Bakhtiyarpur P.S.Case No. 281 of 2018 registered under Sections 147,148,149 and 302 of the Indian penal Code. Allegation against the petitioner is that he along with several other named accused persons and some unknown persons intercepted the brother of the informant and assaulted him by lathi, danda, rod, brick-bats as well as by Garasa and there is specific allegation against one Dinesh Singh of assaulting by Garasa on the head of the brother of the informant due to which he succumbed to injuries.

Submission of learned counsel for the petitioner is that no specific allegation has been attributed against and furthermore there is allegation against 14 named and unnamed accused persons of assault and postmortem report shows only one injury and reason behind implication of this petitioner is that earlier in

Patna High Court CR. MISC. No.7113 of 2019(3) dt.04-04-2019 2/2 a murder case, brother of the informant including others were made accused.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Barh ,Patna in connection with Bakhtiyarpur P.S. Case No. 281 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that petitioner has to co-operate in investigation and shall appear as and when required.
