Neither the allegation of rape is against the petitioner nor the allegation of cutting the neck of victim is against the petitioner and it is only stated that petitioner was also sighted on the road at the time of alleged occurrence and moreover, the informant claimed that her family members had seen the petitioner standing on the road at the time of alleged occurrence. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri M.K.

Patna High Court Cr.Misc. No.34384 of 2015 (2) dt.28-08-2015 2/2 Srivastava, Judicial Magistrate 1st Class, Siwan in connection with Basantpur P.S. Case No. 58 of 2015.

However, the learned trial court should expedite the trial of the petitioner and try to conclude the same as early as possible.
