The petitioner seeks bail in Sherghati P.S. Case No. 343 of 2015 dated 30.12.2015 instituted under Sections 387/435/427/34 of the Indian Penal Code and 17 of the C.L.A. Act. The allegation against the petitioner is of setting fire to the cable drum of electricity contractor.

Learned counsel for the petitioner submits that there is no evidence against him and only on suspicion he has been arrested and implicated in the case. He further submits that there has been no

Learned A.P.P. opposes the prayer for bail and submits that the petitioner has criminal antecedent of similar nature and further that at this stage it would be difficult for any person to take a stand against the petitioner in such cases as there is hardly any person who will have the courage to stand up to the activities of a person like the petitioner.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, the Court is not inclined to enlarge the petitioner on bail.

Accordingly, the application stands dismissed. However, the court below shall expedite the trial and conclude the same within nine months.
