JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 31-01-2020 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Kadam Kuan P.S. Case No. 673 of 2019 for the offence under Section 380 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 16.10.2019. He further submits that the F.I.R. was lodged against unknown and the petitioner has been suspected to have stolen the jewellery kept in Almirah of the informant. He submits that nothing was recovered from the possession of the petitioner to implicate the petitioner in the commission of crime. Considering the fact that the petitioner was not named in the F.I.R. and has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with
Patna High Court CR. MISC. No.5642 of 2020(2) dt.31-01-2020 2/2 two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XII, Patna in connection with Kadam Kuan P.S. Case No. 673 of 2019.
