The petitioners seek bail in a case instituted for the offences under Sections 341, 307/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation against the accused persons is that due to land dispute, while the informant at his house, at night, the accused persons variously armed came and shot fire at the informant due to which he sustained injury.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 22.9.2018 and have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. Charge-sheet has been

Patna High Court CR. MISC. No.8503 of 2019(3) dt.10-04-2019 2/2 submitted in the present case. The petitioners have falsely been implicated in the present case due to land dispute. The petitioners are said to have fired upon the victim. Three injuries are said to have been caused. It is further submitted that the petitioners may be released after completion of one year of custody.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R/complaint case. Considering the aforesaid facts and circumstances, it is directed that after completion of one year of custody, the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -VI, Bhabua, Kaimur in connection with Kudara P.S. Case No. 170 of 2018, G.R. No. 1174 of 2018.
