The petitioner seeks regular bail in connection with Rampur P.S. Case No. 279 of 2021 lodged under Sections 25(1b)A, 26 and 35 of the Arms Act. As per the allegation made in the F.I.R., there is recovery of one loaded revolver from possession of the petitioner. He was arrested on spot.
Learned counsel for the petitioner submits that charge sheet has already been filed in this case and petitioner is in custody since 30.08.2021. He fairly submits that he is not sure whether charge has been framed in this case or not. He also submits that there are two criminal cases pending against the petitioner, one is of the year 2014 in which he is on bail. He also
Patna High Court CR. MISC. No.6862 of 2022(2) dt.13-06-2022 2/2 submits that in the second case, petitioner was granted bail during the pendency of the present application. Learned A.P.P. has opposed the prayer for bail on the ground that recovery of loaded revolver has been made from possession of the petitioner.
Considering the facts that charge sheet has been filed in this case and petitioner is in custody since 30.08.2021, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Rampur P.S. Case No.279 of 2021, but only after completion of 12 months of custody period and framing of charge by the Trial Court. Accordingly, the bail application stands disposed of.
