The petitioner seeks bail in Birpur P.S. Case No. 72/2018, instituted for offence under Section(s) 30 and 32 of the Bihar Prohibition and Excise Act, 2016.
It is alleged in the written report that on getting secret information regarding unloading of huge quantity of foreign liquor from truck, police party reached at the place of occurrence. Seeing the police party 7 to 8 persons started running away. Out of them one person was apprehended by the police, who disclosed his name as petitioner. The police recovered total 1064 litres of foreign liquor from aforesaid truck. Petitioner is said to be driver of the truck. It is alleged that foreign liquor was being carried under the rice bag.
Patna High Court Cr.Misc. No.6056 of 2019(2) dt.05-02-2019 2/2 Keeping in view the recovery of huge quantity of illicit liquor from the truck, of which petitioner was driver, this Court is not inclined to grant bail to the petitioner at this stage. Accordingly, prayer for bail of petitioner is rejected. The trial court is directed to expedite the trial and make efforts to conclude the same as early as possible preferably within six months from the date of receipt of copy of order.
Petitioner is given liberty to renew prayer for bail in the event trial is not concluded within aforesaid period. (Sanjay Priya, J) rakhi/- U T
