The petitioner seeks bail in Complaint Case No.C1/81/2014 registered under section 498A of the Indian Penal Code. The wife made an allegation that her mother filed a complaint case alleging therein that the complainant was kidnapped and for that Sitamarhi P.S. Cased No. 749 of 2013 was registered. The police after investigation submitted final form finding the case false. The complainant thereafter filed the case making allegation that her husband demanded money and on account of non-fulfillment of demand of dowry she has been driven out from the house.
Learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.34995 of 2014 (3) dt.19-01-2015 2/2 all the allegations are false and concocted. From the datge of marriage the case is filed either by mother of the complainant or complainant herself. The petitioner is in jail since 01.04.2014.
Learned counsel for the complainant opposed the prayer for bail and submits that the complainant is ready to live with the petitioner. It appears that the petitioner is already in jail for about nine months.
Considering the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of C.J.M, Sitamarhi in Complaint Case No. C1/81/2014.
