The petitioners apprehend their arrest in a case registered for the offence punishable u/s 341, 323, 379, 307, 504/34 IPC. Allegedly, while the informant was trying to pacify quarrel between two groups, the FIR named accused persons including the petitioners caught hold of him and gave an iron rod blow on his head. One Shaddab Hussain came for rescue but petitioner no.2 assaulted him.
It is submitted by learned counsel for the petitioners that petitioners are innocent and have committed no offence. They have been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The allegation
Patna High Court CR. MISC. No.6447 of 2022(3) dt.29-08-2022 2/2 leveled against the petitioners is general and omnibus in nature. In the alleged occurrence, both sides have sustained injuries and there is a case and counter-case between the parties. Petitioners have no criminal antecedent.
Learned APP for the State opposed the prayer for bail. Vide order dated 28.7.2022, case diary and injury report were called for and on perusal of the same, it is evident that the injuries are simple in nature.
Having regard to the facts and circumstances of the case, since the injuries are simple in nature and there is case and counter-case between the parties, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Uchakagaon P.S. Case No.158 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) pallavi/- U T
