2. The present writ application has been filed for quashing of the order dated 10.03.2022 passed in Mutation Case No. 22431R27/ 2021-2022 by the Circle Officer, Musahari, Muzaffarpur.

3. Learned senior counsel for the petitioner submits that during pendency of this writ petition, the petitioner has also preferred appeal before the Deputy Collector, Land Reforms,

Patna High Court CWJC No.2146 of 2023(3) dt.21-08-2023 2/2 Muzaffarpur and in Mutation Appeal No. 474 of 2020-23, final order has been made on 17.04.2023 by which the order dated 10.03.2022 passed in Mutation Case No. 22431R27/ 2021-2022 has been set aside.

4. In this view of the matter, the present writ application become infructuous.

5. The order of the Deputy Collector, Land Reforms, Muzaffarpur has been brought on record by the senior counsel for the petitioner in which it has directed to the Circle Officer, Musahari, Muzaffarpur to pass a fresh order in the said matter.

6. The counter-affidavit has been filed which is not brought on record but senior counsel for the petitioner submits that the Circle Officer, Musahari, Muzaffarpur in the counteraffidavit has not made any comment with regard to compliance of the order passed by the Appellate Court.

7. In this view of the matter, the present writ application is disposed of directing the Circle Officer, Musahari, Muzaffarpur to comply the order dated 17.04.2023 passed by the Appellate Authority within eight weeks, if the appellate order has not been challenged before any higher authority.
