The petitioner is in custody since 04.03.2016 in connection with a case registered for the offences punishable under Sections 323/302/120(B)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that though named in the First Information Report, the only allegation which has been made against the petitioner is that he was seen eating and drinking alongwith the deceased just prior to the time his deadbody was recovered. Admittedly, there is no eye-witness to the killing of the deceased and the allegation of altercation is not with this petitioner but with one Sanjay Yadav. He further submits that similarly situated co-accused, namely, Sunil Kumar Souren has been extended the privilege of regular bail in Cr. Misc. No. 16526 of 2016 vide order dated 26.04.2016.
