JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Originally, the case was registered under Sections 302, 201 of the Indian Penal Code against unknown persons after recovery of dead body of deceased of this case and in course of investigation, the father of the deceased came to police station and identified the photograph of deceased and, thereafter, he made his statement leveling allegation of demand of dowry as well as torturing against the petitioner and his family members. Subsequently, petitioner was arrested and made his confessional statement leading to recovery of blood stained pant from his house.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.34195 of 2014 (3) dt.23-01-2015 well as submissions of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Sessions Trial No. 368 of 2014 arising out of Ismailpur P.S. Case No. 48 of 2013 pending in the court of 4th Additional Sessions Judge, Naugachia, Bhagalpur stands rejected.

However, learned trial court should expedite the trial of the petitioner and try to conclude the same as early as possible. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
