====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 01-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Bakhtiyarpur P.S. Case No. 182 of 2018, instituted for the offence under Section(s) 302, 201 and 120(b)/34 of the Indian Penal Code. Counsel for the petitioner submits that petitioner is not named in the written report.

It is alleged in the Fard-e-beyan that informant had come to her Maikey and on 16.4.2018 at about 5:30 evening her husband had gone to village Khushrupur. She made contact on Mobile phone but no reply was made from him. It is further alleged that on 7.4.2018 at about 6:15 p.m. she received telephonic information that her husband is lying dead at Telma Bigha Tal. She went there and saw the dead body of her

Patna High Court Cr.Misc. No.5746 of 2019(2) dt.01-02-2019 2/2 husband. He had sustained several injuries on his mouth and other parts of the body.

During investigation, the name of petitioner has been disclosed by Renu Devi who was arrested by the police. Counsel for the petitioner submits that aforesaid Renu Devi has already been granted bail by this Court vide order dated 19.11.2018 passed in Cr. Misc. 72128 of 2018. Petitioner is in custody since 18.6.2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge, 1st, Barh, in connection with Sessions Trial No. 682 of 2018 arising out of Bakhtiyarpur P.S. Case No. 182 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
