The petitioner apprehends his arrest in Narayanpur P.S. Case No. 139 of 2021, registered for the offences punishable under Section 420 of the Indian Penal Code, section 3(3)(I) of the Fertilizer Control Order and sections 7(i)(a)(ii) of the Essential Commodities Act.
Allegation against the petitioner is that he was selling fertilizer more than the price fixed by the government and also indulged in black-marketing of fertilizer.
It is submitted that petitioner has been falsely implicated in this case by the informant in collusion with the enemies of the petitioner. In the so-called complaint date and
Patna High Court CR. MISC. No.6472 of 2022(2) dt.01-08-2022 2/2 time of purchase of fertilizer from the shop of petitioner who is registered dealer, is also not mentioned. Only on vague allegation, he is made accused in this case. Petitioner has got clean antecedent.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Bhojpur, Ara in connection with Narayanpur P.S. Case No. 139 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
