JUSTICE MOHIT KUMAR SHAH ORAL ORDER 30-08-2022 Though the present writ petition was filed for quashing the letter dated 16.02.2018 issued by the Circle Officer, Katra, District-Muzaffarpur, whereby and whereunder the Sub-Divisional Officer, East Muzaffarpur, had been informed that appropriate force and a Magistrate has been deputed to give the delivery of possession to the private respondent no. 9, despite the fact that Title Suit No. 191 of 1992 has been decreed in favour of the petitioner apart from the fact that Title Appeal No. 15 of 1995 has also stood decided in

Patna High Court CWJC No.4115 of 2018(3) dt.30-08-2022 2/2 favour of the petitioner by the learned District Court, Muzaffarpur but the respondents have now filed a counter affidavit, in pursuance to the order of this Court dated 19.07.2022, wherein it has been stated that the aforesaid letter dated 16.02.2018 issued by the Circle Officer, Katra, has been cancelled with immediate effect vide letter dated 02.08.2022 and the respondents do not intend to give delivery of possession to the private respondent no. 9. It is also submitted by the learned counsel for the respondent-State that appropriate steps shall be taken to cancel the Jamabandi and settlement in question forthwith, after giving an opportunity of hearing to the affected parties.

In such view of the matter, the learned counsel for the petitioner submits that nothing further remains to be adjudicated in the present writ petition. Therefore, the present writ petition stands disposed off.
