====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 15-12-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Rampur P.S. Case No. 180 of 2019 (POCSO Case No. 54 of 2019) registered for the offences punishable under Sections 376/302 of the Indian Penal Code and Section 6/8 of the POCSO Act.

The contents of the instruction received by Mr. Jharkhandi Upadhyay, Additional Public Prosecutor, has been communicated by him to the Court orally.

On 29.11.2021, considering the materials available on record, the petitioner was granted interim protection from arrest. I have considered the submissions of the learned

Patna High Court CR. MISC. No.4624 of 2020(7) dt.15-12-2021 2/2 counsel for the petitioner. At this stage, there is no material to even remotely suspect the hand of this petitioner in the crime. Considering the facts and circumstances, the present anticipatory bail application is allowed.

Accordingly, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (POCSO Act), Gaya, in connection with Rampur P.S. Case No. 180/2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
