JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-02-2015 Petitioner is languishing in custody since 01.05.2014 in a case registered for the offences punishable under Sections 302/34 of the I.P.C.

The dead body of the son of the informant was recovered. The First Information Report was lodged against unknown. The name of the petitioner subsequently sprang up in the subsequent statement of the informant when suspicion was raised against the petitioner.

It is submitted by learned counsel for the petitioner that summons were issued against the petitioner in the year 2014. Though the impugned order reflects that petitioner is veteran criminal but a statement has been made in para 3 of the petition that petitioner is accused in one other case apart from the present one.

Considering the suspicious nature of

Patna High Court Cr.Misc. No.34612 of 2014 (3) dt.09-02-2015 2/2 accusation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Madhepura in connection with Uda Kishunganj P.S. Case No. 138 of 1994.

Since the petitioner has criminal antecedent, let learned Court below cancel the bail bonds of the petitioner, if the petitioner defaults for three consecutive occasions during trial.
