The petitioner is in custody since 20.4.2016 in connection with Special (POCSO) Case No.54 of 2016 arising out of Salimpur P.S. Case No.52 of 2016 registered for the offences under Sections 365, 366A of the Indian Penal Code and Sections 8 and 12 of the POCSO Act.
Learned counsel for the petitioner submits that though the alleged occurrence is of 23.3.2016, no F.I.R. was lodged as the parties were known to each other. However, after the girl came back, as an afterthought the parents of the girl filed the present F.I.R. at the instigation of the co-villagers.
