2. The petitioner seeks regular bail in connection with S.Tr. No.109 of 2024 arising out of Kaler P.S. Case No.84 of 2023 lodged under Sections 394 and 307 of the IPC read with Section 27 of the Arms Act.

3. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 07.03.2024 passed in Cr. Misc. No.82739 of 2023 with liberty to renew his prayer for bail 9 months after framing of charge.

4. Learned counsel for the petitioner further submits that the petitioner is in custody since 24.07.2023 and 9 months have already been lapsed. He further submits that charge has

Patna High Court CR. MISC. No.5003 of 2025(3) dt.04-04-2025 2/3 already been framed in this case on 18.03.2024. He further submits that after framing of charge, prosecution witness is going on. He further submits that progress report of the trial has been called for.

5. Counsel further submits that out of 6 witnesses, one witness has been examined and against rest witnesses, nonbailable warrant (NBW) has also been issued.

6. Learned counsel for the State opposes the prayer for bail and submits that material has been found against the petitioner which has been acknowledged in the case diary.

7. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner at present. Therefore, the bail application of the petitioner is hereby rejected.

8. However, it is hereby directed to the Superintendent of Police, Arwal to do the needful and instruct the SHO and I.O. of this case to adduce evidence within 6 months from the date of production of the order as speedy trial is the constitutional vision of justice.

9. Registry is directed to communicate this order forthwith to the Superintendent of Police, Arwal. Registry is further directed to hand over a copy of this order to learned
