JUSTICE BIRENDRA KUMAR ORAL ORDER 23-08-2017 Cr.W.J.C. No. 274 of 2016 was dismissed for nonprosecution on 19.07.2017. This application has been filed for setting aside the dismissal and restoration of the criminal writ, aforesaid. Submission is that due to sudden illness and hospitalization of the mother of the petitioner's counsel, no one turned-up on the date fixed.

Considering the aforesaid statement, on oath, which is a reasonable explanation, the dismissal of Cr.W.J.C. No. 274 of 2016 is set aside and the criminal writ is restored to it's original file.
