JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 17-03-2025 In the present writ petition petitioner has prayed for following reliefs:- "(i) The order dated 23/1/18 passed by learned Collector-cum-District Magistrate in Misc. Case No. 01/17-18 be quashed.

(ii) The petitioner be granted adequate compensation or annual rent or both as the case may be for the lands in question of the petitioner over which Transmission Tower is being erected.

(iii) The petitioner also prays that if possible the Transmission tower going to be erected be diverted/ shifted to any adjoining land, since the land of the

Patna High Court CWJC No.4189 of 2018(6) dt.17-03-2025 2/2 petitioner is a homestead land.

(iv) Petitioner be paid the cost of legal proceeding throughout.

(v) Petitioner be granted any other relief/s permissible under the facts and circumstances of the case."

2. After some argument, learned counsel for the petitioner submits that this case may be disposed with liberty to the petitioner to file appropriate application before the competent authority/ Court for redressal of his grievance.

3. Learned counsel for the State has no objection to this prayer of the petitioner.

4. In view of the submission of learned counsel for the petitioner, this case is disposed of with liberty to the petitioner as prayed for.
