JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The alleged occurrence took place in the year 2005 and petitioner could be remanded in this case on 14.05.2014. It would appear that in the instant case, charge sheets were submitted in piecemeal manners. Moreover, there is allegation against the petitioner that he assaulted the injured Anwar Hussain by means of garasa. Para-29 of the case diary reveals that injured, Anwar Hussain sustained one sharp cut injury but the same was found simple in nature.

The contention on behalf of the petitioner is that other accused have already been acquitted of the charges. Considering the aforesaid facts and circumstances as

No.37069 of 2015 (3) dt.04-11-2015 2/2 well as period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 4th Additional Sessions Judge, Muzaffarpur in connection with Sessions Trial No. 747 of 2014 arising out of Katra P.S. Case No. 92 of 2005.
