Petitioner is languishing in custody since 28.04.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 307, 323 of the I.P.C and 25(1B)a, 27, 35 of the Arms Act. It is alleged that brother of the petitioner Gobind Singh was arrested by the police. The petitioner suspected that his brother was arrested at the behest of the informant's side. So he resorted to fire but it was misfired and subsequently the petitioner was apprehended and handed over to the police from whom one country made pistol and one cartridge were recovered.

It is submitted by learned counsel for the petitioner that informant's side thrust the seized arms to the petitioner but actually there was no recovery from the petitioner.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate/Judicial Magistrate, Siwan in connection with Basantpur P.S. Case No. 135 of 2014.
