The petitioner is languishing in custody for the offences punishable under Sections 401/413/414 of the Indian Penal Code.

Stolen motorcycle was allegedly recovered from the house of co-accused Santosh Das. Petitioner was there and he was apprehended.

Submission is that nothing was recovered from the possession of the petitioner. The petitioner is in custody since 04.10.2018. The petitioner has been implicated only on the basis of criminal antecedent of the petitioner. Investigation of the case is already complete.
