The petitioner being the husband of the daughter of the informant is languishing in custody since 25.04.2016 in a case registered for the offences punishable under Sections 498A of the Indian Penal Code and 3/4 of Dowry Prohibition Act.
The basic accusation is of torture for nonfulfillment of the dowry demand. It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the daughter of the informant, Anita Kumari, on 19.05.2015 and it was the informant who took his daughter to his house after ten days of the marriage. A supplementary affidavit has been filed to the effect
Patna High Court Cr.Misc. No.24847 of 2016 (3) dt.30-06-2016 2/2 that the daughter of the informant has performed second marriage. Considering the nature of accusation and the period under custody, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-5, Saran at Chapra in connection with Manjhi P.S.
