The present application has been filed for modification of the order dated 19.12.2018 passed in Cr. Misc. No. 63454 of 2018 by which the petitioner was granted bail in connection with Shahpur P.S. Case No. 201 of 2018 to the satisfaction of learned Additional Chief Judicial MagistrateVIIth Danapur, Patna and the petitioner was directed to surrender in the Court below within a period of six weeks and furnish bail bonds.
Learned counsel for the petitioner submits that in the petition of Cr. Misc. No. 63454 of 2018, inadvertently in the prayer portion, in place of learned Additional Chief Judicial Magistrate-1st Danapur, Patna, learned Additional Chief
Patna High Court Cr.Misc. No.4765 of 2019(2) dt.30-01-2019 2/2 Judicial Magistrate-VIIth Danapur, Patna had been typed, resultantly, in the last paragraph of order dated 19.12.2018, in place of "learned Additional Chief Judicial Magistrate-1st Danapur, Patna ", it has been typed as "learned Additional Chief Judicial Magistrate-VIIth Danapur, Patna". Considering the submissions made on behalf of the learned counsel for the petitioner and the grounds mentioned in the modification application, the same is allowed. Let in the last paragraph of the order dated 19.12.2018, in place of "learned Additional Chief Judicial Magistrate-VIIth Danapur, Patna", it shall be read as "learned Additional Chief Judicial Magistrate1st Danapur, Patna". Further, the period of surrender of the petitioner in the Court below is extended for a further period of six weeks from the date of receipt/production of a copy of this order. The rest of the conditions stipulated in the order will be same.
The order dated 19.12.2018 passed in Cr. Misc. No. 63454 of 2018 is modified to the extent as indicated above. The modification application is, accordingly, allowed. (Sudhir Singh, J) Pankaj/- U T
