The petitioners pray for grant of anticipatory bail in connection with Nasriganj P. S. Case No. 17 of 2020 registered for the offence punishable under Sections 379, 411, 420 and 34 of the Indian Penal Code and Rule 56 (1), 56 (2) Bihar Minerals (Concession, Prevention of Illegal Mining, Transportaion & Storage) Rules, 2019 and Section 15 of Environment Protection

The petitioners have been made accused in this case because the Poclain Machine was found illegal sand mining. Pursuant to the order dated 21.02.2022, the Superintendent of Police, Rohtas personally present along with his report dated 22.03.2022 which is taken on record. In the report, it has come that the Poclain Machine belonging to the petitioner was engaged in illegal extraction and loading of sand.

Considering the aforesaid fact, this application for anticipatory bail is dismissed. The interim protection granted to the petitioner stands vacated. The Police is free to proceed against the petitioners in accordance with law. The personal appearance of the Superintendent of Police, Rohtas is dispense with.
