KUMAR ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 24-03-2022 Petitioner has prayed for the following relief(s): "(i) For making payment of the total amount of rupees 7,10,818/- (Seven Lakhs, Ten Thousand, Eight Hundred Eighteen only) which remained due to be paid by the respondents to the petitioner against the food materials, such as biscuits,

Patna High Court CWJC No.2045 of 2022(2) dt.24-03-2022 2/3 namkeen, Kinley water bottles, sabji (vegetable), which the petitioner being an authorized contract agreement holder, authorized by the North Eastern Railways, Varanasi supplied in the Shramik Special Trains at Chapra Junction on different dates, i.e. from 0905-2020 to 27-06-2020, during the pandemic Covid-19 lockdown period, on the oral order of the Assistant Manager, IRCTC, Lucknow, Uttar Pradesh (Respondent No. 9) given on telephone as well as through whatsapp text message to the petitioner.

(ii) Also for making payment of the statutory interest amount of 12% on the total amount which remained due to be paid calculating the same from its actual date of payment.

And (iii) Also for any other relief/reliefs for which the petitioner is found entitled."

Learned counsel for the petitioner, under instructions, states that the petitioner shall be content if the petitioner is permitted to withdraw the present petition, with liberty to initiate appropriate proceedings before the appropriate forum and to take recourse to such other alternate remedies which are equally efficacious in law.
