The petitioner seeks bail in connection with P. (POCSO) Tr. No. 136 of 2021 arising out of Motihari Muffasil (Lakhaura) P.S. Case No. 125 of 2019.

In view of the deposition of PW 01 and PW 02, no useful purpose will be served by keeping the petitioner further in custody as both, the victim and her father have become hostile and they have not supported the allegation against the petitioner.

Learned A.P.P. has vehemently opposed the prayer for bail.

Patna High Court CR. MISC. No.8301 of 2023(3) dt.22-03-2023 2/2 Considering the aforesaid fact, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 6th-cum-Special Judge POCSO, Motihari, East Champaran in connection with P. (POCSO) Tr. No. 136 of 2021 arising out of Motihari Muffasil (Lakhaura) P.S. Case No. 125 of 2019.

As a condition of this order, the petitioner should cooperate in the proceeding of the Court below and if the petitioner tries to delay the trial, the Court below is at liberty to pass an appropriate order including the cancellation of bail bonds of the petitioner.
