JUSTICE SANJAY PRIYA ORAL ORDER 3/ 21-11-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner apprehends his arrest in Udwant Nagar (Gajrajgarh) P.S. Case No.158 of 2017 instituted for the offence under Section(s) 20/22 of the NDPS Act. It is alleged that 10 Kg. Ganja was recovered from the house of this petitioner. Petitioner managed to run away while one of the co-accused, Pankaj Singh, was apprehended. He disclosed that the petitioner along with another accused as named in the written report has managed to run away. It is further alleged that thereafter police also committed raid in the house of Brajesh Singh @ Mukhiya, on the information given by Pankaj,

Patna High Court Cr.Misc. No.47953 of 2017 (3) dt.21-11-2017 2/2 and recovered 8 Kg. Ganja from his premises. Brajesh Singh alias Mukhiya also managed to run away from the place of occurrence.

As such, it appears that the petitioner and others were indulging in the illegal trade of Ganja. In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.

Prayer of the petitioner for grant of anticipatory bail is rejected.

Petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law preferably on the same day without being prejudiced by this order.
