JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 14-07-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceeding. Learned counsel for the petitioner undertakes to remove the defects within four weeks of resumption of normal court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioner seeks bail in connection with Kawakole (Rupau) P.S. Case No.157 of 2019, registered under sections 147/149/341/323/307/353/337/338/427/186/226/504/506 of the Indian Penal Code.
The allegation against the petitioner is that while the police was arresting one Mithilesh Yadav because of
Patna High Court CR. MISC. No.16784 of 2021(2) dt.14-07-2021 2/3 commission of some offence, this petitioner along with one Sanoj Yadav reached there and threatened the police personnel not to arrest. Many villagers also attacked the police by lathidanda and bricks due to which they received injuries and government vehicle was also damaged.
It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence as alleged in the FIR. No offence as alleged has ever took place. He has been falsely implicated in this case as he is brother of the co-accused Mithilesh Yadav. There is no specific allegation against the petitioner rather the same are general and omnibus in nature. He was only a member of the mob. Several similarly situated co-accused persons have been granted bail by different co-ordinate Benches of this court, as mentioned in para-10 of the bail petition. The petitioner has no criminal antecedent and has been languishing in custody since 16.11.2020. Learned APP for the State opposed the prayer for bail. Considering the facts and circumstances of this case, since similarly situated co-accused persons have been granted bail, the above named petitioner is also directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the
