The petitioner seeks bail in connection with Darigaon P.S. Case No. 19 of 2024 instituted for the offence under Sections 126(2), 115(2), 109, 352 & 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act. 3.
Prosecution case in short is that over a quarrel, coaccused, namely, Rudal Bind has ordered the petitioner to fire upon husband of the informant. On said order, petitioner has allegedly fired upon the husband of the informant and he has sustained injury.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17-10-2024. Petitioner
Patna High Court CR. MISC. No.10085 of 2025(3) dt.08-04-2025 2/3 bears no criminal antecedent/s, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Learned counsel frankly submits that at the instigation of the co-accused, petitioner has fired upon the husband of the informant, due to which he sustained grievous injury. There is no eye witness to the occurrence. Learned counsel submits that petitioner is a student and there is previous enmity from the informant's family, due to which petitioner is implicated. Charge sheet is submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. Petitioner has confessed his guilt in his confessional statement. Injury report corroborates with the allegation levelled in the FIR. Other witnesses have supported the prosecution case. 7.
Considering the aforesaid facts and circumstances of the case, taking into account the specific allegation of firing against the petitioner which is duly corroborated with the injury report, this Court, at this stage, is not inclined to grant bail to the petitioner. Prayer for grant of bail is rejected. 8.
The Trial Court is directed to expedite the trial as
Patna High Court CR. MISC. No.10085 of 2025(3) dt.08-04-2025 3/3 expeditiously as possible without any undue delay and unnecessary adjournments.
